The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Domainyze, Inc.
  • Cookies are small files placed on Your device by the Service, used to store information such as Your preferences and browsing activity.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Domainyze web application.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • WHOIS/RDAP Data refers to publicly available information about domain name registrations obtained through WHOIS and RDAP protocols. This data may include, but is not limited to, registrant contact information (name, organization, address, email, phone), administrative and technical contacts, nameservers, registration and expiration dates, and domain status codes.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting Your Personal Data

Types of Data Collected

Personal Data You Provide to Us

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. This may include, but is not limited to:

  • Email address
  • First name and last name
  • Billing information (processed by our payment provider, Stripe)

Data Collected Automatically (Usage Data)

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

WHOIS/RDAP Data — Including Third-Party Registrant Information

We collect and store WHOIS/RDAP Data for the domain names You choose to monitor through the Service. This data is publicly available and is retrieved directly from WHOIS and RDAP servers operated by domain registries and registrars.

WHOIS/RDAP records can include personal data about a domain's registrant — who is often not Our customer and has not directly interacted with Us. We process this data on the basis of Our legitimate interest in providing the domain-monitoring functionality of the Service, and because it is drawn from a source the registrant has made publicly available through the domain registration process. Many registries and registrars redact or limit registrant personal data by default (particularly for registrants in the EEA and UK), which reduces the personal data We receive through this channel. If You are a domain registrant with a concern about data appearing in WHOIS/RDAP records, We encourage You to contact Your registrar directly, as they control what is published; You may also contact Us using the details at the end of this Policy.

Cookies and Similar Technologies

We use Cookies to operate the Service and, where You consent, to understand how the Service is used. Before any non-essential Cookie is set, We display a cookie consent notice on the Service, and non-essential Cookies (such as analytics Cookies described below) are only placed once You have given Your consent through that notice. You can withdraw or change Your consent at any time through the same notice or Your browser settings; Strictly Necessary Cookies (for example, those required to keep You logged in or to maintain security) do not require consent and cannot be disabled without affecting the Service's core functionality.

Information from Third-Party Services (Analytics)

Where You have consented via Our cookie notice, We use third-party analytics services to understand how users interact with our Service, improve user experience, and optimize our features. These services collect data directly from Your browser or device:

  • Google Analytics: Collects data about Your usage of the Service, such as pages visited, time spent, and interactions. This data is anonymized where possible.
  • Microsoft Clarity: Collects data on user behavior, including heatmaps, session recordings, and user flows, to help us identify usability issues and improve the Service's design.

Using Your Personal Data

The Company may use Your Personal Data for the following purposes:

  • To Provide and Maintain our Service: Including to monitor the usage of our Service and to deliver the core functionality of Domainyze, such as tracking domain statuses and sending alerts.
  • To Manage Your Account: To manage Your registration as a user of the Service. The Personal Data You provide enables You to access different functionalities of the Service available to You as a registered user.
  • For Service Improvement and User Experience: To analyze usage trends, identify areas for improvement, and enhance the overall user experience, where You have consented to analytics Cookies.
  • For the Performance of a Contract: The development, compliance, and undertaking of the purchase contract for the products, items, or services You have purchased or of any other contract with Us through the Service.
  • To Contact You: To contact You by email, or other equivalent forms of electronic communication, regarding updates, security alerts, or informative communications related to the functionalities, products, or contracted services.
  • For Compliance and Security: To comply with legal obligations, enforce our terms, and protect the security and integrity of our Service. This includes adhering to WHOIS/RDAP policies and preventing any malicious or unauthorized use of the data.

Specific Use of WHOIS/RDAP Data

The WHOIS/RDAP Data we collect is used exclusively for the purpose of providing our domain monitoring service. This includes:

  • Determining the current status of a monitored domain (e.g., active, expired, pending delete).
  • Identifying key dates such as registration and expiration.
  • Extracting registrar information and nameserver details.
  • Triggering alerts based on changes in domain status or availability.

We explicitly state that we do not use WHOIS/RDAP Data for marketing purposes, nor do we engage in any malicious use or activities that violate WHOIS/RDAP policies. This data is processed solely to deliver the core functionality of the Service you subscribe to.

We Do Not Sell Your Personal Data

We do not sell Your Personal Data, and We do not share it with third parties for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA) or similar laws. The third parties described in this Policy receive data only to perform services on Our behalf (such as processing payments or providing analytics), not to use it for their own independent marketing purposes.

Sharing Your Personal Data

We may share Your Personal Data in the following situations:

  • With Service Providers: We may share Your Personal Data with service providers to monitor and analyze the use of our Service, to process payments, or to contact You. These include:
    • Google Analytics (for website analytics)
    • Microsoft Clarity (for user behavior analytics)
    • Stripe (for payment processing)
  • For Business Transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: If the Company forms or acquires any corporate affiliates in the future, We may share Your information with those affiliates, and We will require them to honor this Privacy Policy with respect to that information.
  • With Your Consent: We may disclose Your Personal Data for any other purpose with Your consent.
  • Legal Obligations: We may disclose Your Personal Data in the good faith belief that such action is necessary to:
    • Comply with a legal obligation.
    • Protect and defend the rights or property of the Company.
    • Prevent or investigate possible wrongdoing in connection with the Service.
    • Protect the personal safety of Users of the Service or the public.
    • Protect against legal liability.

International Data Transfers

Some of the service providers listed in this Policy, including Stripe, Google Analytics, and Microsoft Clarity, may process Personal Data in the United States or other countries outside of Your own. Where We transfer Personal Data of individuals in the EEA, UK, or Switzerland to a country that has not been deemed to provide an adequate level of protection, We rely on appropriate safeguards recognized under applicable law, such as Standard Contractual Clauses or the receiving provider's own certified transfer mechanism, to protect that data.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

WHOIS/RDAP Data for monitored domains is retained for as long as the respective domain is actively monitored by You through the Service. Upon deletion of a monitored domain or termination of Your account, this data is removed from Our active systems; residual copies may persist in encrypted backups for a limited period (typically no longer than 30 days) before being permanently purged in the ordinary course of Our backup rotation.

Security of Your Personal Data

The security of Your Personal Data is important to Us. We implement commercially reasonable technical and organizational measures designed to protect Your Personal Data from unauthorized access, use, alteration, or disclosure. However, remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

For WHOIS/RDAP Data, while the data itself is publicly available, we apply the same security standards to its storage and processing within our systems as we do to other Personal Data.

Data Breach Notification

If We become aware of a security breach affecting Your Personal Data, We will notify the relevant supervisory authority within 72 hours of becoming aware of it, where required by applicable law. If the breach is likely to result in a high risk to Your rights and freedoms, We will also notify You directly without undue delay.

Your Data Protection Rights (GDPR & CCPA Compliance)

We are committed to respecting Your data protection rights. Depending on Your location, You may have the following rights:

  • Right to Access: The right to request copies of Your Personal Data.
  • Right to Rectification: The right to request that We correct any information You believe is inaccurate or complete information You believe is incomplete.

To protect Your Personal Data, We may need to verify Your identity before acting on a request, using information reasonably necessary to confirm You are who You say You are. We will respond to requests from individuals in the EEA/UK within one month of receipt, extendable by a further two months for complex requests; We will respond to requests from California residents within 45 days, extendable by a further 45 days where necessary, and We will inform You of any extension and the reason for it.

Regarding WHOIS/RDAP Data: While this data is publicly available, we respect your rights concerning any personal data we store that is linked to your account or monitoring activities. You can manage your monitored domains directly within your account dashboard.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
